MahaRERA witnesses first successful Conciliation Forum session : Rajan Bandelkar

MUMBAI : In the new regulatory regime post the Real Estate (Regulation and Development) Act, 2016 (RERA), Maharashtra has been the first state to implement a conciliation forum as an alternative dispute resolution platform.

“The Conciliation Forum of MahaRERA comprises developers and members of Grahak Panchayat of Mumbai and Pune,” said Dr Niranjan Hiranandani, CMD, Hiranandani Communities and President (Nation), NAREDCO. “The Conciliation Forum aims to lessen the burden of the MahaRERA. The conciliation forum aims to resolve cases amicably, instead of dragging legal proceedings,” added Rajan Bandelkar, Vice President, NAREDCO.

The first such working day of the Conciliation Forum saw 16 cases come up for conciliation, of which, five cases were resolved on the same day. Another case has been resolved, but the parties decided to sign the conciliation at a later date.

In Mumbai, the Conciliators were Dr. Niranjan Hiranandani & Mr. Rajan Bandelkar from (NAREDCO) while Mrs. Smita Jamdar & Dr. Archana Sabnis from the Mumbai Grahak Panchayat (MGP).

Developers and the Projects taken up in the Mumbai Conciliation Forum were of L&T Realty, ACME Housing, Tridhatu Group, Ekta Group and the Lavaasa Group. “Most cases received were of delayed possession, Cancelation and Refund. Both the parties were heard and made to talk to each other to arrive a mutual agreement between them,” said Rajan Bandelkar.

The Conciliation Forum of the Maharashtra Real Estate Regulatory Authority (MahaRERA), Mumbai and Pune both we t through 16 cases on day one. While 5 issues were resolved, parties decided to sign the conciliation note on a later day in the sixth case. Of the five solved cases, three are from Mumbai's Powai area, and two are from Pune. The case where the conciliation note is yet to be signed is from Pune.

In Mumbai, the result on day 1 was 80 per cent of the cases were successfully dealt with. Cases were taken up keeping in mind a solution for the financial burdens of the customers and easing their liability, said Rajan Bandelkar, adding that the parties agreed either for interest payment, alternate financial solutions or earlier possession assurance. “This first such Conciliation Forum is a precursor to many more to come. The MahaRERA Conciliation Forum is committed, and will try to put all efforts to resolve issues that are crop up between Consumers and Developers,” he concluded.
